European Lawyers Council Disappointed at Chinese Authorities Blocking Beijing lawyer Li Heping from Going to Brussels to Receive Human Rights Award
The Brussels-based Council of the Bars and Law Societies of Europe (CCBE) is disappointed at the Chinese authorities for not allowing Beijing human rights lawyer Li Heping (李和平) to go to Brussels on 27 November to receive the lawyers council's Human Rights Award.
CCBE president Péter Köves said the council will write to the Chinese government to express their disappointment and deplore that Lawyer Li was not allowed to go to receive the award.
In response to CHRLCG's enquiry, CCBE said they will request a meeting with the Chinese ambassador in Brussels concerning the matter. They are also going to request the External Relations service of the European Commission to deliver the Award to Lawyer Li.
CCBE, which has over 700,000 members, issued a press release on 28 November announcing to grant this year's Human Rights Award to Beijing human rights lawyer Li Heping and to a group of 26 Spanish lawyers who represented defendants and victims in the trial following the 11 March 2004 Madrid train bombings.
CCBE established the Human Rights Award in 2007 "to highlight the work of a lawyer or lawyers' organisation that has brought honour to the legal profession by demonstrating outstanding commitment and sacrifice in upholding fundamental values." The first award was given to (Avocats Sans Frontières)(Lawyers Without Borders) last year.
CCBE's press release quoted its president Péter Köves as saying: "The CCBE is proud to honour lawyers who undertake such important work in different circumstances and on different continents. The stories behind the lawyers who have won the award this year highlight the vital role of the lawyer in upholding justice and the rule of law. We salute the winners, who have made us all proud to be members of the same profession. We very much regret that Li Heping was not permitted to leave China to receive the award at the CCBE Plenary Session."
The press release also cited Lawyer Li's statement sent to the CCBE as saying: "This award is not only an honour and encouragement to me alone, but to all human rights defenders, including human rights lawyers, in China who have strived to uphold the values of human rights in a challenging environment. I am encouraged by the award and will work even harder and with greater passion towards fulfilling the universal values of human rights, democracy and the rule of law in China and beyond."
Introducing Lawyer Li's background, CCBE noted that Lawyer Li represented Falun Gong practitioners, fellow Beijing human rights lawyer Gao Zhisheng, blind "barefoot lawyer" Chen Guangcheng in Shandong, many villagers whose lands were expropriated, and political dissidents during his legal practice for over ten years. CCBE also expressed concern about Lawyer Li being subjected to various intimidations in his work.
China Human Rights Lawyers Concern Group (CHRLCG) congratulates Lawyer Li for receiving the CCBE Human Rights Award. It shows the European lawyers' recognition of Lawyer Li's work and other mainland human rights lawyers' work. CHRLCG also strongly protests against the acts of the public security officers at the Beijing airport customs for blocking Lawyer Li from going to Brussels to receive the award. It also shows the Chinese authorities' disrespect of lawyers in preventing him to receive an award from a legal profession organization. The public security officers' acts were not legally grounded.

歐洲律師公會對中國政府阻止北京律師李和平赴比利時領人權獎表示 失望
總部設在比利時布魯塞爾歐洲律師公會(Council of the Bars and Law Societies of Europe)(CCBE) 對中國政府阻止北京維權律師李和平11月27日到布魯塞爾接受本年度的「人權獎」表示遺憾,該律師公會主席Péter Köves表示會致信中國政府對此表達不滿。
歐洲律師公會在接受本會查詢時表示會就此事要求會見中國駐布魯塞爾大使,另外亦會要求歐盟委員會(European Commission)外事部把獎項交予李和平律師。擁有七十多萬會員的歐洲律師公會於11月28日發出新聞稿, 宣佈把今年的人權獎一同頒贈給北京維權律師李和平,以及26名受馬德里律師公會委任為2004年3月11日西班牙馬 德里火車恐怖襲擊爆炸案被告與受害者提供法律援助的西班牙律師。
歐洲律師公會於2007年設立人權獎,「 以表揚個別律師或律師團體在維護基本價值方面表現出色,敢於承擔與犧牲,為法律界爭光」。 去年第一屆獲獎的是無國界律師組織(Avocats Sans Frontières)(Lawyers Without Borders)。

歐洲律師公會介紹李和平律師的背景時, 特別指出李律師在超過十年的執業當中,曾為法輪功學員的宗教自由辯護, 並曾為北京維權律師高智晟及山東失明「赤腳律師」陳光誠辯護,也提及李律師為許多被強行拆遷的農民及政治異見人士提供法律援助 。歐盟律師公會也特別關注李律師因參與這些維權工作而受到恐嚇。
中國維權律師關注組恭賀李和平律師獲得歐洲律師公會人權獎,這是歐洲同行對李律師及中國維權律師的工作的肯定。 本會對北京機場海關公安人員阻止李和平赴布魯塞爾接受這個律師同 行給予的獎項表示強烈抗議。當局阻止李律師接受歐洲律師同行的獎項充分反映中國政府不尊重律 師,而且公安阻止李律師的行為完全欠缺法律依據。

CCBE Human Rights Award granted jointly to a Chinese lawyer, Li Heping, and to the group of Spanish lawyers who intervened in the 11/3 Madrid bombing trial
The Council of Bars and Law Societies of Europe (CCBE), representing over 700,000 lawyers from the European Union and European Economic Area through their member Bars and Law Societies, has granted its 2008 Human Rights Award to Li Heping, a well-known Chinese lawyer, and to the group of Spanish lawyers who represented defendants and victims in the trial following the 11 March 2004 Madrid train bombings.
The prize was created in 2007 by the CCBE in order to highlight the work of a lawyer or lawyers' organisation that has brought honour to the legal profession by demonstrating outstanding commitment and sacrifice in upholding fundamental values.
Li Heping was prevented by police from leaving Beijing at the airport on Thursday 27 November, and so is unable to receive his award in person.
CCBE President, Péter Köves, said today: "The CCBE is proud to honour lawyers who undertake such important work in different circumstances and on different continents. The stories behind the lawyers who have won the award this year highlight the vital role of the lawyer in upholding justice and the rule of law. We salute the winners, who have made us all proud to be members of the same profession. We very much regret that Li Heping was not permitted to leave China to receive the award at the CCBE Plenary Session."
In a statement sent to the CCBE, Li Heping said: "This award is not only an honour and encouragement to me alone, but to all human rights defenders, including human rights lawyers, in China who have strived to uphold the values of human rights in a challenging environment. I am encouraged by the award and will work even harder and with greater passion towards fulfilling the universal values of human rights, democracy and the rule of law in China and beyond."
Endika Zulueta San Sebastian, the representative of the group of Spanish lawyers which received the award, said: "Despite the shortage of material and economic means that we endured as legal aid lawyers, we used all our legal knowledge and our dialectics to defend the rights of persons charged with the cruellest terrorist attack suffered on European soil, in the centre of a media and political pressure without precedent."
He added: "We would like to honour the victims of that fatal attack of the Madrid bombings of 11/3/2004 and especially those who were present during the five-months of the oral phase of the trial. Despite having to face the people accused of causing such painful suffering, they withstood the process with admirable fortitude and serenity, allowing the State to respect not only the basic guarantee of a legal defence, but also the best possible defence for any person regardless of the seriousness of the alleged crimes."
Background
Li Heping is a lawyer who has been active in human rights for over 10 years. He acted as an advisor of the Falong Gong, trying to ensure the respect of freedom of religion, as well as acting on behalf of his well known colleagues Chen Guancheng and Gao Zisheng. He has acted as a lawyer for many villagers in China whose property has been expropriated and also defends political dissidents prosecuted in China. In carrying out these functions and in his fight to protect and stand up for the basic human rights of Chinese citizens, Li Heping has always suffered and is persistently the victim of various intimidation methods. Yet, he courageously continues his fight for values which are common to all: rule of law and the respect of human dignity.
The group of Spanish lawyers worked on trial following the 11 March 2004 Madrid train bombings. The Madrid Bar appointed through its legal aid scheme 23 lawyers for the defence and 3 for the prosecution. The lawyers involved in the trial of the 11/3 bombing had to overcome immense obstacles to duly exercise their task that their own professional careers and private lives were affected. The pressure was particularly strong for those lawyers in charge of representing the suspects. It had to be added to the very tight deadlines, to the insignificant remuneration, and to the costs of withstanding such a burden in their personal and professional life, which included in some cases the closing of some of the law firms for over one year losing income and clients.
The 2007 Award was granted to the organisation Avocats Sans Frontières.
