Dear Sir or Madam,

I am writing to you to ask your immediate intervention into an
extremely unjust trial in China. Xia Junfeng, in an attempt to
self-defend himself from brutal attack by urban management officials
(chengguan), unfortunately killed the two attackers. The court in
Shenyang, in his first trial, just sentenced him to death penalty plus
600,000 yuan of financial penalty. On June 29, Xia will have his
second appeal trial -and then perhaps go to the Supreme Court. The
situation is extremely urgent.  We consider this is a very important
case, because every city in China has chengguan bureaus, which employs
millions of people. It is an extremely abusive system, and caused
countless innocent people's death. To sentence Xia to death penalty
can only make the chengguan system more abusive and subject more
people to its tyranny without any chance of redress.

Xia Junfeng and Zhang Jing are among the poorest families in China.
That was why they chose to be vendors, since both were laid off.
China's corrupt and polarized society forced millions into the bottom-
no job, no social welfare. Millions of Chinese people have to work as
small vendors on the streets, but they always have to watch out for
Chengguan, who may come any time to take away their stuff and even
physically assault them. On May 16, 2009, Xia and Zhang just started
their business. When Chengguan came, they wanted to forcefully take
away everything. The couple begged chengguan to allow them to keep
those since that's everything they had. But then Chengguan started to
beat up Xia despite Zhang knelt down to beg them to stop. Chengguan
then forcefully grabbed Xia into their car. In Chengguan's office,
three men beat up Xia fiercely. In an attempt to defend himself, Xia
took out his small knife (for preparing food), killed two and injured
one. Xia has a 9-year-old son. His wife is also unemployed. During his
detention, Xia went through very abusive incarceration.

Xia's wife in her letter said, "I used to believe that the court is a
honorable place, a just place and I dared not to breathe when I got
there. But the whole trial was a joke. The lawyer was always
interrupted and not allowed to speak for my husband. Several witnesses
who support Xia was also not allowed to speak out. Can you call this a
court? Can I hope to see my husband alive again? How can I ever in my
life time be able to pay that astronomical number of fine? "

The case of Xia is just the tip of iceberg of the numerous victims who
are subject to the abuse of Chengguan. This type of urban management
officials, chengguan, does not and should not have the authority of
police, even according China's own law. However, chengguan often use
brutal force in their daily administrative work. There are already
many incidences of Chengguan killing people. For example, in Hubei,
Wei Wenhua was killed when he just took pictures of Chengguan
attacking an ordinary small vendor.

City administration enforcement squads (城管) have an abysmal
reputation. Tasked with checking permits and keeping street vendors
from setting up unlicensed stalls, their methods frequently result in
violent altercations that sometimes land rule-breakers in the hospital
or morgue. (Danwei.com)
In China, chengguan has literally become synonymous with violence.

"The use of unnecessary brute force by urban management officials to
oppress people is a fact of life across China. The beating to death of
an innocent citizen...is truly unthinkable," Yao Lifa told Radio Free
Asia.

We believe the Chinese judicial system cannot give him a fair trial,
thus, we urgently ask you to contact the corresponding Chinese
governmental and judicial organs to put pressure on them so that they
give Xia a fair trial. China's law says, legitimate self-defense is
not a crime.
