       这两天看到邮件组里广州的两个民间组织相继退出中盖项目,他们用不同的方式表达了基金会管理人员的不满。我作为深圳的一个草根民间组织,对此事表示密切的关注。牵牛花组织,是跟我们一起成长起来的小幼苗,我知道他们没有什么资金支持,跟我们一样,大都是因为感染HIV后,为了求生存,为了自己和身边的朋友多活一点时间而走入这个圈子。

       进入这个圈子后,听说了很多纷争,看到了很多现象,也不想掺和进来,也想息事宁人,但我们这些感染者组织无路可退,我们要跟HIV共存,也要跟比这个HIV还难根除的人性的丑恶共存。

      我是一个新入行的草根游民,对前段时间邮件组里出现的北京全球基金项目办官员----关宝英,这次全球基金六轮项目广州项目办、中盖项目广州负责人----徐惠芳,刚好都只有一面之缘。这两个居然是那么惊人的类似,一个是从北京市卫生占线上退下的前官员,一个是广州市疾控中心的在任领导。此两位女中豪杰,都是公仆,都是为人民服务的角色,却在处理艾滋病领域里的服务工作中,都采用极其相似的棒喝方法。

      让我感到非常不解: 两个人都身材魁梧,膀大腰圆,本应是心胸宽阔之人,为什么做法跟面相有如此差距?

      让我更吃惊的不是他们面相的问题,更是他们处理事情的逻辑思维能力:

       这些政府工作人员同时又拿着外国基金会的票子的"人",你们难道不明白为什么这么多民间组织成立吗?

       你们攻击和批评民间组织的时候,说是一帮为了追逐利益的人成立民间组织。难道你们心里不明白根本原因吗?还不是你们不作为,还不是你们不称职,还不是你们不合格,才有这么多民间组织为你们这帮吃闲饭的人补位吗?

     为了项目费用?你问问全国上百个组织,又有哪个组织在这个领域的公益工作中赚到了钱?

       如果基金会管理人员是老外,用国外的一个新的眼光新的标准来评判我们,我们不如国外做的好,我们也就认了。你们批评我们工作部到位的时候,想过主要责任在谁吗?我觉得这是个天大的笑话。

        基金会项目有考核机制,"不合格"的民间组织要被你们拿下?政府工作有没有考核机制,你不合格是不是该被什么人拿下?

         艾滋病的流行趋势得不到控制,你们呆在官位上的这些人,有没有想过自己要为此负什么责?把责任推在一些不拿任何工资,没有任何资源的民间组织身上?你们不觉得脸红吗?这些民间组织透支着他们生命的光亮,还不是为照亮你们留下的阴暗角落?
    
      这种棒喝,让我想起了两组画面:画面一,妈妈在打犯错孩子的屁股;画面二,疯狗在咬无防卫能力的幼童。真诚希望这些双重官员的内心出发点是前者而不是后者。

李庄案判决无罪并移送北京司法局处理的公民建议

 

 

重庆市高级人民法院:

  重庆市江北区人民法院今日对被告人李庄伪造证据、妨害作证案一审公开宣判,判处有期徒刑二年六个月。

我们是中华人民共和国公民,根据《宪法》和《刑事诉讼法》规定,特向贵院提出建议,请予以参考。我们建议贵院对李庄伪造证据妨碍司法一案,判决无罪并,通过司法建议书,移送北京司法局处理。

经过仔细研读控辩双方的意见,我们认为李庄伪造证据妨碍司法一案,确实不成立。

高子程律师的辩护词中说,截止李庄被刑拘,李庄接触过的与龚刚模案有关的诉讼参与人唯有龚刚模。依龚刚模在中央台被采访时回答,只是李庄的眨眼和眼神使龚刚模猜测是让龚刚模翻供,龚刚模的这种猜测显然不能认定李庄有教唆龚刚模翻供的行为。这一访谈已然证明,李庄根本没有教唆龚刚模翻供谎称被刑讯逼供。

陈有西律师的辩护词,12月10日龚刚模检举李庄引诱他伪证的第一份笔录,(《检察卷》112页),就露出了马脚。龚交代说:“接着,他(李庄律师)问我被刑讯逼供了没有。我说被吊了的。” (P113) “他问我:‘在审查中你被打了吗?’我就说:‘被吊了几天,还不准吃饭’。他说:‘这些话你要在法庭上讲出来。’”(P114)“我在法庭上问你被刑讯逼供时,你要大声承认,还要把刑讯逼供的过程演示出来。”

陈有西律师还披露说,尽管离审讯时间已经有六个月,龚刚模被刑讯吊打的腕部伤痕仍然清晰可见。色素沉着清晰。重庆法医验伤所的12月29日作出的《法医临床学鉴定书》(重法[2009]临鉴12字第5926号)报告结论为:龚刚模左腕部色素沉着、减退区系钝性物体所致擦伤后遗留。这一重要证据显示了龚刚模确实被长期悬吊过。

龚刚模被刑讯逼供之外的,李庄被律师指控犯罪行为,通过吴家友贿买警察作假证,与要求他人做伪证,通过两位律师辩护,已经证明没有事实和法律依据。

犯罪嫌疑人李庄辩护说,伪造证据妨碍司法必须是“将已经伪造的证据提交司法机关,或者对积极要求向司法机关作证的人实施威胁、恐吓、阻扰、干扰等妨害行为,因而使司法机关对案件的性质、情节等做出错误的判断,情节严重的行为。”,迄今为止,李庄从未向重庆任何司法机关提交过任何形式的证据,因所有证据都在调查、收集、核实之中,均未形成最后的证据物质形态。根据排除法则,“伪造证据”之说显然不能成立。

以上是来自犯罪嫌疑人和辩护人的观点,为了平衡,我们也想引用控方的观点,可是控方除了上纲上线和挥舞专政武器之外,没有丝毫牵强的理由,可以供我们引用。

律师本来就有一种法律范围之内,与检方的对抗性,必须在灰色领域游走。也就是其必须用不够成违法的手段,或者插边球的手段,尽可能地为犯罪嫌疑人提供无罪,罪轻,从轻处罚的辩护。改变“被告”的“口供”,甚至叫犯罪嫌疑人龚刚模翻供,都是对抗检方的手段之一,就像检方站在其立场,也很有可能从重,或者疑罪从有,或无中构罪。

在法院判决之前,没有任何机关,单位和个人,可以判定犯罪嫌疑人有罪。在这个之前,就决定决定律师是否可以叫犯罪嫌疑人翻供,是否提供伪证妨碍司法,是法盲的暴政。只有当犯罪嫌疑人被法院审理判决认定有罪,才能回头审视律师的灰色行为。可以说重庆方的做法,违反了“未经法院判决不为罪”的原则,通过打黑的政治运动,未审犯罪嫌疑人龚刚模就先入为主认定有罪,于是李庄必然是提供伪证妨碍司法罪犯。

律师刑事辩护豁免权,是指律师在法庭上的辩护言论,不受法律追究的权利。目前,世界上不少国家均不同程度地赋予了律师这一权利,如美国、英国、法国、德国、日本、卢森堡、荷兰等国的有关法律均对此作了比较具体的规定。是否应当赋予律师刑事辩护豁免权,我国律师界和法学理论界早已提出这一问题,且大多持肯定意见,但在《律师法》的起草过程中有关部门对此争议较大,最终未能写进《律师法》。我们认为,应当赋予律师刑事辩护豁免权,并且从李庄案开始。

一个政治行动,是否获得民意的支持或者默认,很大程度上,并不是其动机是否纯洁,而是其手段是不是过界,例如对李庄,不采取重庆法办的方式,而是让北京司法局进行惩处,或许可能就满足“‘罪’责相当”原则。一旦过界,就勾起人们对文革的反感,对不讲法制的恐惧,因此李庄就成为被同情的对象,甚至作为赞美的对象,作为改革路线对抗文革路线的英雄。其手段是否理性审慎,而不是其目的本身,成为是非判断的转折点。

我们想提醒法院的是,根据海内外刑法权威的学理解释,伪造证据妨碍司法罪是结果犯罪,未遂是不犯罪的。

我们认为李庄律师不构成犯罪。根据疑罪从无,一样必须无罪认定。若重庆方确信李庄有违法或者触犯律师职业伦理之处,请通过司法建议书,请将证据移送北京司法局,交由北京方面处理。

【权利:2992】 再论洗脑教育与不合作

如果我们在自己的生活中只是关心孩子的动物性成长,而不是孩子的灵魂,我们在社会治理的层面就会收获同样的政府治理模式。

让我们脱离"不要做中国人的孩子"的诅咒。

为了满足孩子的物质需要,中国的父母们敢于付出多大的牺牲和爱啊!如果我们愿意将这种奉献和勇敢精神转而用在为孩子的灵魂、孩子的自尊的成长上面的,我们是可以很容易脱离这个诅咒的。我相信我们能做到。

明白这个道理,我们将不再愿意在任何地方作灵魂搅拌机上一个麻木的、机械的齿轮,比如:管制言论的官僚和公务员、谎话连篇的教材编者和发行人、传讲洗脑课程的教师、掩盖或者阉割真相的记者、编辑、律师等。我们将愿意尽力通过各种方法反对那些洗脑教材,乃至拒绝再参加洗脑课程的考试等等。

不合作的道路就是如此,为了自由和尊严,愿意承担不便甚至艰难。

对重庆打黑行动渎职侵权行为展开调查的法律建议书

重庆打黑专项斗争开展以来,受到海内外的高度关注也赢得了社会各界的诸多赞誉。与此同时,近一个时期以来,重庆打黑行动能否严格恪守社会主义法治,在深挖罪行除恶务尽的同时能否严格遵循程序正义保障基本人权让犯罪分子罚当其罪又让无辜者免受臧害避免问题政治化、扩大化也越来越遭受质疑。甚至有人认为,一场法治行动正在逐渐演变成泛政治化运动一场新的文革即将到来!近来尤其以李庄为代表的近20名律师在刑事辩护过程中被采取强制措施所引发的争议甚嚣尘上。仅就李庄案所披露的信息而言,涉黑被告人龚刚模等是否受到刑讯逼供、龚刚模举报李庄律师的真实过程、李庄案发生时中青报迅即带有显著倾向性报道的背后内幕、李庄案一审庭审中8名证人均未出庭质证的原因等等,不单对于司法程序、面对社会公众,深入全面查清李庄案及所有案件背后的事实真相并使其得到令人信服的结论已成不容回避的现实!

我国执政党和政府历来强调实事求是,将其作为指导思想和工作方法,执政党和政府在“追求真理、修正错误”历经几代人付出沉重代价后最终选择了法治,来之不易的法治正是实现实事求是的一套理想工具和标准无论从实体上还是在程序上来看,一切罪与非罪、是非对错要得到真相做出结论就得依靠法治。

在以打黑任务为中心的重庆打黑专项斗争中,在有关方面全面政治动员、思想宣传及社会热烈反响的特定背景下,个别执法工作人员存在头脑发热、立功心切、毕其功于一役、忽视法治程序,作为执法人员一切站在其中心任务的立场上看待问题不难理解与想象,由此在大量繁重的反黑工作任务面前产生错误甚至发生违法渎职行为的可能性也是不容忽视的课题特别是:刑讯逼供、滥用职权、玩忽职守、非法拘禁、报复陷害、非法搜查、暴力取证、体罚、虐待被监管人员、妨害作证、打击报复证人、伪证、枉法追诉、枉法裁判、徇私枉法等现象,一些问题在龚刚模案、李庄案的证据瑕疵以及程序违法中(如联合办案、如对刑辩律师会见的监视干扰等)似有表现,对此不能不有所警惕。

重庆打黑其实不仅是一次在全社会推进反黑恶势力、反腐败、树立正气构建和谐社会的努力,更是一次弘扬法治精神的重大契机,最终社会正义能否得以伸张取决于全社会的理性、智慧与勇气,取决于从上到下执法人员的责任、成熟度更有赖于全社会的法治信念。

鉴于,李庄案业已对全国产生重大影响之基本事实,鉴于此案必然关乎的律师执业权利保障、国家整个刑事司法制度兴废存亡乃至依法治国事业全局,并在实质上能够有力支持重庆打黑专项斗取得进一步实效,使其沿着依法、客观、公正、全面、准确的方向演进,避免冤家错案维护法律尊严保障公民合法权利,把所有打黑案件办成经得起历史检验的铁案高度对人民负责,最终达到法律效果和社会效果相统一为全国树立典范之目的,根据《刑事诉讼法》第十八条、第二十二条、《人民检察院刑事诉讼规则》第十三条之规定,最高人民检察院应及时履行法定职责按照渎职侵权案的管辖规定组成专案组,在中纪委、中央政法委全力支持下赴渝完成法律监督和渎职侵权侦查任务,严把案件质量关,不使一个罪犯漏网,不让一个无辜者蒙冤,有错必纠,惩前毖后,同时以正视听,增强执政党、政府公信力,将依法治国事业落实到底!

综上,根据《中华人民共和国宪法》第四十一条中华人民共和国公民对于任何国家机关和国家工作人员,有提出批评和建议的权利;对于任何国家机关和国家工作人员的违法失职行为,有向有关国家机关提出申诉、控告或者检举的权利之规定,特提出此建议。

1.                 Medical parliamentarians discuss emerging health issues

50 parliamentarians with medical background from Asia, Africa, Central Asia, Latin America and the Caribbean assembled in Bangkok from 19-20 December to discuss emerging health issues. The workshop of medical parliamentarians was organized by AFPPD in cooperation with UNFPA, the Government of Japan, WHO and the International Medical Parliamentarians Organization (IMPO).

The meeting concluded with the adoption of a final statement entitled "From Advocacy to Legislative Initiatives," calling on governments to increase or sustain financing for public health and calling on the IMPO to expand partnerships with parliamentarians, regional parliamentary networks and international agencies to improve health conditions for their people.

2.                 NGOs trained on reproductive health advocacy

In collaboration with the German Foundation for World Population (DSW) and the World Health Organization (WHO), AFPPD organized and implemented the Southeast Asia Regional Workshop on "Advancing Healthy Advocacy for Reproductive Health" in Bangkok from 1-3 December. Attended by 21 participants of civil society organizations from Indonesia, the Philippines and Thailand, the workshop aimed to ensure government funding is increased and resources are sufficiently available for Reproductive Health in the new aid environment. The workshop was facilitated by Ms Karen Hoehn, Vice Executive Director, DSW Brussels; Ms Maria Bordallo, EU Project Officer, DSW Brussels; and Mr Dale Huntington, Scientist, WHO.

3.                 AFPPD Chairman delivers Salas Memorial Lecture

On 23 November, Mr Yasuo Fukuda, MP of Japan and Chairman of APFPPD, delivered this year's Rafael M. Salas Memorial Lecture at the UN Headquarters in New York City. The lecture focused on "Challenges for Sustainable Development in a New Era: Population, Climate Change and Global Security." Mr Fukuda said he is "convinced that parliamentarian activities in the field of population and development will become ever more important as we strive for the welfare of all people, and for democratisation and good governance to ensure individual dignity as the foundation and benchmark of global security."

4.                 AFPPD 66th Executive Committee Meeting in Tokyo

The 66th meeting of the AFPPD Executive Committee took place in Tokyo on 7 December under the chairmanship of Mr Yasuo Fukuda, MP and former prime minister of Japan. Also in attendance were Sir Dr Puka Temu, Deputy Prime Minister of Papua New Guinea; Ms Nobuko Horibe, Director of UNFPA Asia-Pacific Regional Office; Ms Kiyoko Ikegami, Director of UNFPA's Office in Tokyo; and members of parliament from Australia, Cook Islands, Malaysia, Thailand and Vietnam. The committee expressed satisfaction and pleasure in the large number of activities undertaken by AFPPD in 2009 and its support for parliamentarians' participation in key events organized by other international and regional agencies. The committee also reviewed proposed plans for 2010.

5.                 HIV/AIDS bill to go before India Parliament

The long pending legislation on HIV-AIDS that aims to protect the rights of people living with the disease will be tabled in Parliament in its next session."The consultation work on the Bill has been expedited as we want it to be tabled in the next session of Parliament. It is a serious matter and we want it be passed as soon as possible," Parliamentary Forum for HIV and AIDS Chairman Oscar Fernandes said.

The Bill was drafted in 2006 to protect the rights of people living with the disease and to prevent and control the spread of the infection. It followed intensive discussions with different stakeholders, including people with HIV, sex workers and drug users, and has been pending with the government for the last three years, reports IANS.

6.                 Parliamentarians visit Burkina Faso

Parliamentarians from India, Iran, Maldives, Nepal and Vietnam participated in a study visit to Burkina Faso organized by the Burkina Faso World Bank Country Office, the World Bank Parliamentary Relations Team, and the Parliamentary Network on the World Bank (PNoWB), with support from AFPPD, from 30 November to 4 December. Parliamentarians gained a first-hand understanding of Burkina Faso's handling of the impact of the global financial crisis, decentralization and social accountability, extractive industries revenue management, and the impact of reforms on improving investment climate.

7.                 New report on Maternal Mortality in India receives parliamentary support

The Center for Reproductive Rights launched its new report "Maternal Mortality in India: Using International and Constitutional Law to Promote Accountability and Change" at the recent 5th Asia Pacific Conference on Reproductive and Sexual Health and Rights, on 18 October in Beijing. Mr P.D. Rai, MP of India and member of AFPPD Standing Committee of Male Parliamentarians on Prevention of Violence against Women and Girls, was the keynote speaker at the launch and he spoke about the importance of this report as a tool to promote accountability and to raise awareness about the challenges that India faces in reducing preventable maternal mortality and morbidity. He emphasized the need to invest more on in women's health and to redouble the efforts to achieve the commitments made through the MDGs. Finally, he reaffirmed his commitment as a Parliamentarian from Sikkim in India to promote women's health and well being.

8.                 AFPPD took part in online discussion of men's role in gender-based violence

On 16 December, the Population Reference Bureau hosted an online interview with Mr Todd Minerson, White Ribbon Ambassador, on the topic of "Engaging Men in the Fight to End Violence Against Women." AFPPD inquired about how male MPs could most effective address violence against women and good practices in the region. Mr Minerson said one of the key messages for parliamentarians is "the necessity to make the links between the promotion of gender equality and the reduction of violence against women." 9.                 Lower chamber of Spanish parliament passes law on SRH

The Lower Chamber of the Spanish Parliament approved the Organic Law on Sexual and Reproductive Health and the Volutary Interruption of Pregnancy. According to El Pais, 184 MPs voted in favor, 158 against and 2 abstained. The Popular Party, in opposition to the government, changed their spokesperson on the issue for a more moderate one.

Amendments include the right to individual conscientious objection, mandatory sexuality education in schools, subsidies for modern contraceptives and the obligation for adolescents aged 16 and 17 to have parental approval for an abortion, unless this consent would entail domestic violence. The socialist government emphasizes that the objective of the law is to prevent unwanted pregnancies and consequently reduce the number of abortions; to grant women the right to decide about becoming a mother and to delete abortion as an item in the penal code.

EarthRights International's Mekong School is a unique training program for civil society advocates from the Mekong Region (China, Burma, Laos, Thailand, Cambodia, and Vietnam) who are working on environmental and human rights issues.  The seven month-long training program focuses on the impacts of large-scale infrastructure projects, particularly hydropower dams, and how citizens are engaged in advocating for more equitable development in the Mekong region.  At the school, students investigate community complaints regarding negative impacts from Asian Development Bank (ADB), World Bank, and privately funded projects.  Through a series of field visits, students examine the threats posed by various projects, such as the series of hydropower dams currently planned and under construction along the mainstream of the Mekong and its tributaries, to migratory fish stocks, local livelihoods, and regional food security.  Finally, program graduates focus on ways in which they can join together as alumni to advocate for policy reform with the ultimate goal of promoting greater public participation and transparency in development planning in the Mekong region.  

 

The goals of the Mekong School session are:

-          for students to develop an understanding of the impacts of hydropower dams and other large-scale development projects, as well as the views and approaches of various stakeholders

-          for students to understand and analyze what methods communities have utilized for greater protection of human rights and the environment

-          to develop students' practical skill base in research, advocacy and campaign work; and

-          to develop strong relationships, networks and concrete campaign plans for implementation upon graduation and the students' return to their respective countries.

 

Our ideal candidates are individuals who have been active on environmental, human rights, or community development issues, who are enthusiastic about partnering with other activists from the region and who have the capacity to become effective community leaders and/or advocates.  The training takes place in Chiang Mai, Thailand from June to December of each year, and includes a two-month practicum in which students return to their home countries to conduct field work. Housing, transportation, and a modest living stipend are provided to successful candidates.
